Laundry Malice Not Likely

In Wyoming they must take their laundry very seriously. A Casper assisted living home has been sued over a woman's fall and her resulting death. These facts are serious and may deserve a lawsuit for compensation. The women allegedly tripped over laundry left on the floor by an employee of the home. Probably a negligent employee, I would say. But, the lawsuit accuses the assisted living facility of "malice, gross negligence, wantonness, willfulness and/or recklessness." Whoa!

It may turn out that the employee really had it in for the women resident. Bad blood does flow in some veins. If so, however, we are talking manslaughter here.

The story from the Associated Press:

CASPER - A Casper man sued the assisted living home where he retired with his wife, saying his wife died from injuries she suffered when she tripped over laundry left on the floor by an employee of the home.

Forest Haines is seeking more than $75,000 from Park Place Assisted Living LLC, Sunwest Management Inc. and several unnamed defendants for medical and funeral bills, emotional suffering, loss of companionship and punitive damages.

Wally Gutzler, attorney for Salem, Ore.-based Sunwest, said Friday he had not seen the lawsuit and typically wouldn't comment on pending litigation.

According to Haines' lawsuit, his wife of 61 years, Monica Haines, was healthy before the March 19, 2004, incident. That night, Haines said, a Park Place employee opened the door to the Haines' apartment after they'd gone to bed, leaving a package of laundry on the floor.

Monica Haines woke up that night and walked to the kitchen to get a drink; not knowing the laundry would be there, she tripped and fell, hitting her head. After that, her health deteriorated quickly, the lawsuit said, until she died on Aug. 30, 2004.

The lawsuit accuses Park Place and Sunwest of "malice, gross negligence, wantonness, willfulness and/or recklessness."
